New Waterford woman challenges gas, oil leases
LISBON – Lynnelle Thompson Zimmerman of New Waterford filed a lawsuit Friday claiming a long list of gas and oil lease companies should have no leases on property she owns on Gavers Road near Summitville.
The lawsuit filed in Columbiana County Common Pleas Court claims there have been several documents signed beginning in December 1991 regarding the property, assigning oil, gas and mineral rights first to one entity and then to another. Between 1991 and 2013, the lawsuit claims there was 11 different transfers of the gas and oil rights between companies completed. The final one in January 2013 placed the area in the hands of Chesapeake Exploration.
Other companies listed as defendants are Chesapeake, Total E and P USA, StatOil Onshort Properties, Axiom Energy, Range Resources Appalachia, CHK Utica, Lomak Operating Co. and Great Lakes Energy Partners. Additionally, there is one individual named, Robert F. McVicker, MD, of Columbus.
Zimmerman claims none of these companies have any valid right or interest in the property and asks the court to quiet the title, declaring the mineral rights should belong to the owner, Zimmerman.
Zimmerman is being represented by Columbiana attorney Mark Hutson.
