EP man claims food poisoning after McDonald’s meal

LISBON — An East Palestine man is suing the local McDonald’s Restaurant claiming he received food poisoning after eating a sandwich from the restaurant a year earlier.

Michael Henry, Waterford Road East, East Palestine, contends he and his girlfriend, Audrey, purchased two orders of french fries, a double hamburger and a McChicken sandwich at 10:55 a.m. Feb. 12, 2016. Both ate the french fries and Henry ate the McChicken sandwich about 20 minutes after it was purchased. According to Henry, it was the first food he had consumed other than a bottle of water since 4 p.m. the day earlier.

While the girlfriend did not become ill, Henry said he started feeling nauseous about 30 minutes after he ate the sandwich. He began vomiting uncontrollably at 1 p.m. and vomited outside the car window as he drove himself to the St. Elizabeth Hospital in Boardman. For the next two days after eating the sandwich, Henry said he had constant stomach pain. He noted the hospital staff diagnosed him with gastroenteritis, which can be transmitted by eating tainted food.

Henry believes the mayonnaise on his sandwich may have been contaminated with bacteria after being stored in too warm a location near the ovens and cooking surfaces.

Henry is seeking $50,000 plus interest in his lawsuit, which was filed by attorney Jan. R. Mostov of Youngstown. The McDonald’s in East Palestine is owned by the Telischak Company.
