Free Choice act will allow anything but

A threat to democracy at a very basic level - in the workplace - has resurfaced in Congress. It is the Employee Free Choice Act, an inappropriately named bill if ever there was one.

Last year the measure was blocked by lawmakers concerned about true freedom of choice for working men and women. But the proposal has been introduced again in Congress.

Should the bill become law, it would make changes in the rules involving labor unions and employers.

Regulations now provide for a two-tier process by which workers decide whether they want a union. If 30 percent or more of workers at a particular site sign union authorization cards, formal balloting takes place. Then, if a majority of workers vote in favor of a union, it is certified as their bargaining agent.

Taking advantage of the true free choice in the secret ballot process, many Americans reject unions. Some estimates are that as few as 7.5 percent of U.S. workers belong to them.

If the Employee Free Choice Act becomes law, that would change. There would be no guarantee of secret ballot elections before a union took over. Instead, unions could be certified if a majority of a company's workers signed authorization cards - presented to them in public, quite possibly in front of groups of pro-union co-workers. Obviously, intimidation would be a factor.

Another stipulation in the bill is that if a new union could not agree to a contract with a company within 90 days, the matter could be referred to a federal mediator. If no agreement could be reached 30 days after that, the dispute would be referred to arbitration. Results of the arbitrator's decision would be binding on the union and the company for two years - even if union members disagree with them.

Former Sen. George McGovern, the Democratic Party's nominee for president in 1972, has been a good friend of labor unions. He has broken with them on this issue. In an opinion piece in the Wall Street Journal, McGovern stated that the Employee Free Choice Act "runs counter to ideals that were once at the core of the labor movement. Instead of providing a voice for the unheard, EFCA risks silencing those who would speak."

Concerning approval of unions solely through authorization cards, McGovern noted, "There are many documented cases where workers have been pressured, harassed, tricked and intimidated into signing cards ..." He added, "Under EFCA, workers could lose the freedom to express their will in private, the right to make a decision without anyone peering over their shoulder, free from fear of reprisal."

McGovern has a persuasive answer to members of Congress who insist that they have to support organized labor leaders who backed them. In his opinion article last summer, McGovern put it this way: "While it is never pleasant to stand against one's party or one's friends, there are times when such actions are necessary I hope some of my friends in Congress will re-evaluate their support for this legislation. Because as Americans, we should strive to ensure that all of us enjoy the freedom of expression and freedom from fear that is our ideal and our right."

The distinguished public servant is right. Members of Congress who truly want free choice for workers should vote against the dishonestly titled Employee Free Choice Act. They should stand with McGovern - for what is right.

I know you are not reading this, but I must add that your facts are a little off. Polls show that a majority of Americans are for this law. I hope that the democrats are listening to their supporters on this. If not then we might as well vote for the opposition party. Good luck trying to feed perople who read your papers half the truth. Your doing a great service to your country!!

Still think it was a fair and ballanced piece? If soooo many workers are against unions then why worry about this law? Pleas don't tell me about the ridiculous ides of voter intimidation. According to you a majority will not sign the cards because of their anti union feelings. Right. I want my newspaper to educate me on the issues not give me only one side. By their selection of columnists I do not feel that I get both sides. That is what I mean by fair and balanced. The fact that I am either pro or anti union makes no difference to the whole truth about an issue. I can live with the editors opinion if it was balanced by others who supported the other side. Signed NOT ANGRY!

Please read the following. Does the Employee Free Choice Act take away so-called secret ballot elections?

No. If one-third of workers want to have an NLRB election at their workplace, they can still ask the federal government to hold an election. The Employee Free Choice Act simply gives them another option—majority sign-up.

“Elections” may sound like the most democratic approach, but the NLRB process is nothing like democratic elections in our society—presidential elections, for example—because one side has all the power. The employer controls the voters’ paychecks and livelihood, has unlimited access to speak against the union in the workplace while restricting pro-union speech and has the freedom to intimidate and coerce the voters.

This is the real truth about the law. The editors can have an opionion about this law but readers deserve all of the facts. A;so please stop asking me why I am mad. I am not and enjoy having a discussion like this.

Potter i am sorry but i still don't see what you are mad at. The editorial guru pointed out the Employee Free Choice Act in an OPINION. If anything it's supports the Obama Admin and even Dems are coming out against it. If your conservative to some ideas then what the heck are you doing even trying to make it a liberal vs. conservative fight. Unless you are trying to dictate that if you are for Unions you are Democrats and if your against them you are Republican. Of course, if that was true Obama wouldn't be the President. Read the opinion. The number of people that are against Unions vs. those who want them is staggering. But it speaks volumes of truth.

Therefore, I will just use the same quote the editorial guru used: "Members of Congress who truly want free choice for workers should vote against the dishonestly titled Employee Free Choice Act." The guru was fair and balanced. He didn't say Democratic or republicans congressman now did he?

I went back and read all the editorials for the year. All of them were anti Obama or anti any policy he wants to try. Newspapers are supposed to be the "WatchDog" of the Government not a proponent of one political point of view. Your bias is very clear ! I am keeping a list for the week of all the articles on your editorial page for the week. Interesting to see the results. I would like to see the views from both sides on issues in order to understand issues better. Believe it or not but I am conservative on a lot of issues. But I am also not a "DITTO HEAD" I like to make up my own mind.

When I read this editorial page on an issue I know what side the paper will take almost every time. And you are right I should not have made it a DEM. vs. REP> issue but a Liberal vs. Conservative one. Most people are a little of both on different issues.

I have been informed more by reading your post than reading this papers' editorial. The paper does not have to write stories that agree with my point of view. Would be nice to read both sides of an issue though. Still going to get a better newspaper though.

Still does not change the fact that this newspaper group does a very poor job of keeping it's readers informed. They still write editorials that are slanted to the right. They only told you what they saw as wrong about this bill. They did not say what was good about the bill. I am also not angry or mad at the opponents of this bill,they have a right to oppose it. Just would like to see a better job of reporting ,thats all. Would be nice to read both sides of an issue!

But then again Potter maybe you need to find out why it your big Union heads are having a heated discussion with the Dems right now about this big power play that the Dems want in being able to seize and takeover big Unionized failures?

Let me see if I understand this. Potter you are angry at those special teams (LOL) for doing what they are doing even though the UNIONS are doing the same exact thing. Yep makes sense to me.

Your editorial page is really only giving on side of most issues. "REPUBLICAN" Just look at your editorial page and who you have featured there. Look who you backed for President and how you areb already started bashing our President. I will cancle my subscription.If I only want Republican talking points I might as well watch Fox News all day. I don't need this from my paper too. I will get the Youngstown paper, MORE BALLANCED!

Really? Go to Wall Mart and try to even talk to a worker. The company has a special team the call to make sure workers will not try to sign up for a union. They have even closed stores to prevent a union. How come you never write a story on this kind of intimidation? People are scared of their employer not each otherve me a break. You really think Wall Mart workers do not want a union? Get real
