Case dropped involving felonious assault dating back to 2005

LISBON - A man who was denied a previous request to have a criminal charge against him dismissed had his case dropped after all.

Shawn Chambers, 33, of New Cumberland, W. Va., was scheduled to face trial today for felonious assault, a second-degree felony, for allegedly using his vehicle to harm Frankie Harris on Nov. 16, 2005 by dragging Harris down the road for several blocks in East Liverpool.

The Columbiana County Prosecutor's Office filed a motion in Common Pleas Court to have the indictment dismissed because the victim in the case, Frankie Harris, couldn't be located. Judge C. Ashley Pike granted the motion.

Chambers' attorney, Joseph Ludovici, tried to have the charge dismissed previously by arguing that too much time had passed from the time of the incident and Chambers' initial arrest when he was served with the indictment in November 2008.

He had already pleaded guilty in East Liverpool Municipal Court to leaving the scene of an accident and reckless disregard for safety and was placed on probation with some jail time when the incident occurred in 2005. The indictment was issued in February 2006, but he wasn't served with it until two and a half years later.

The prosecutor's office also requested and was granted the dismissal of two other indictments.

Timothy Patrick, 24, whose last known address was Wellsville, had an indictment for domestic violence, a fourth-degree felony, dismissed after the prosecutor noted the victim was no longer cooperating in the prosecution of the case. The motion said she believed the case was going to be dropped and that the defendant, Patrick, just scared her. Documents alleged he attempted to harm a woman he knows on Feb. 18, with a previous conviction for domestic violence against him in East Liverpool Municipal Court.

An indictment for complicity to burglary, a third-degree felony, against Amanda Martin, 27, of 1019 Hazel St., East Liverpool, was dismissed after the prosecution cited new information received regarding her involvement in the burglary. The indictment had alleged that she helped two other people in the burglary at a Wellsville residence on Aug. 25.

Also in Common Pleas Court:

Scott McKinnon, 48, of 325 Moore St., East Liverpool, was sentenced to 12 months in prison for two counts of breaking and entering, a fifth-degree felony, from two separate indictments. He received credit for 79 days already served in jail. Documents said he broke into Quick Cash in East Liverpool on June 27, 2008 and again on Aug. 3, 2008, stealing miscellaneous coins and jewelry.

James Dearth, 44, of 806 Sixth Ave., LaCroft, East Liverpool, was sentenced to prison for eight months for breaking and entering, a fifth-degree felony, with credit for 17 days already served in jail. Documents said on Jan. 19, 2007, Dearth and another man entered a residence on Ogden Street in East Liverpool which had been boarded up and closed to entry by order of Common Pleas Court.

Danny Brand, 45, of 115 E. Sixth St., East Liverpool, pleaded guilty to possession of drugs, a fifth-degree felony, with sentencing Sept. 10. He had originally been charged with possession and tampering with evidence. Documents said he possessed cocaine in East Liverpool on June 24, 2007.

Conan Thompson, 21, of 10924 Stookesberry Road, Lisbon, was placed on probation under community control for four years for breaking and entering and theft, both fifth-degree felonies. Documents said Thompson broke into Calcutta Towing in East Liverpool on Oct. 3, 2008 and stole tools and equipment from a garage storage area.

David Haught Jr., 23, of 928 Florence St., East Liverpool, was sentenced to prison for six months after his intervention contract for possession of cocaine, a fifth-degree felony, was terminated due to violations of the terms. He received credit for 145 days already served in jail and his license was suspended for six months. Documents said he possessed a glass crack pipe containing cocaine on March 22, 2007 in East Liverpool.

Dana Thornton, 44, of 416 Johnson Place, Wellsville, was sentenced to 90 days in the county jail for assault, a fourth-degree felony, after his probation was terminated due to violations. Documents said he struck a Wellsville police officer in the face and kicked him on Jan. 9, 2006 when he was trying to execute an arrest warrant against him.

John Felton III, 33, of 136 Ravine St., East Liverpool, pleaded guilty to illegal conveyance of prohibited items onto the grounds of a detention facility, a third-degree felony, and possession of drugs, a fifth-degree felony, with sentencing Sept. 24.

Documents said Felton had cocaine hidden in his shoe when he was being booked into the county jail on Dec. 1, 2006.
