Norfolk Southern lawsuit recently settled, dismissed
LISBON — A lawsuit filed by an insurance company against Norfolk Southern over the Feb. 3, 2023 train derailment and chemical release in East Palestine was recently settled and dismissed with prejudice.
The Columbiana County Common Pleas Court entry didn’t disclose the terms of the settlement between California Casualty Indemnity Exchange, Bloomfield Hills, Mich. and the railroad headquartered in Atlanta, Ga.
The insurer filed the lawsuit earlier this year seeking reimbursement for money paid out to the owner of a property on West Grant Street in East Palestine for alleged damages caused by the derailment.
According to the lawsuit, the insured’s real property or home required repairs totaling $11,723 and the insured’s personal property was damaged requiring replacement, repair or destruction in the amount of $14,428.
A payment of $26,152 was made to the client and that’s the amount of damages the insurance company sought.
