Columbiana police officer files appeal regarding promotion test

LISBON -- A Columbiana police officer has filed an appeal against the city of Columbiana Civil Service Commission about the scoring method used in a civil service promotional test.

Richard Whitfield has asked Common Pleas Court to look at the decision of the city's civil service commission on Aug. 7.

Whitfield took a civil service test seeking a promotion within the department. The commission had ruled that Whitfield should not get the 5 percent bonus for his score for having an associate's or bachelor's degree. In the commission's interpretation of the rules and regulations, the bonus only applies to those seeking an initial police position, not for someone seeking a promotion.

However, Whitfield disagrees with that interpretation. The bonus for military service is limited only to those taking the entrance exam and a seniority bonus is only for those taking the promotional exam.

But Whitfield and his attorney, Jason M. Rebraca, question an interpretation of the rule which limits the bonus for those taking the promotional exam.

The lawsuit asks the court to look at the legal language of the rules and regulations of the municipal civil service commission and interpret the language and intent of the statute.
