Appeal denied in child porn case

LISBON — A Lisbon man sentenced to at least 10 years in prison for multiple felony counts related to his possession of nude images of children recently lost his appeal.

Matthew Spack, 39, state Route 172, had filed the appeal with the Seventh District Court of Appeals in Youngstown to challenge the consecutive sentences he received in June 2025 in Columbiana County Common Pleas Court.

Judge Megan Bickerton ordered the consecutive sentences for each count, bringing Spack’s prison term to at least 10 years with a possible maximum sentence of 11 years dependent on a decision by the Ohio Department of Rehabilitation and Corrections.

Two counts warranted indefinite sentences of two to three years each for pandering obscenity involving a minor or impaired person, a second-degree felony.

Bickerton sentenced him to six months each for five counts of pandering obscenity involving a minor or impaired person, a fourth-degree felony, and seven counts of illegal use of a minor or impaired person in nudity-oriented material or performance, a fifth-degree felony.

That brought the total minimum sentence to 10 years. For the indefinite terms, the Ohio Department of Rehabilitation and Corrections can decide to tack on up to an additional year.

Spack received credit for 60 days served in jail.

He was also designated a Tier II sex offender requiring him to register for the sex offender registration every 180 days for 25 years. He entered guilty pleas to the charges in April 2025.

According to the appellate court ruling, Spack claimed ineffective defense counsel, that the court failed to include findings in the judgment entry regarding consecutive sentences and that the imposition of consecutive sentences wasn’t supported by the record.

The appellate court disagreed, finding that defense counsel was not ineffective and affirming the imposition of consecutive sentences.

The appellate court remanded the case back to Common Pleas Court only to correct the court entry to reflect the required language for the imposition of consecutive sentences.

According to a police affidavit filed in county Municipal Court, Spack was accused of creating, reproducing or publishing videos depicting children engaging in sexual activity. When officers executed a search warrant at his house, images depicting minor females in a state of nudity were found on his cell phone. The date listed on the indictment for the offenses was Nov. 13, 2024.
